Dhobiflow Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of Dhobiflow, including our website, mobile app, and related services (together, the "Service"), operated by Dhobiflow, based in Nairobi, Kenya ("Dhobiflow," "we," "us," or "our").

By checking the "I agree" box when signing in to the Dhobiflow mobile app, or by otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. When we do, we will increase the version number and effective date shown above, and the version you most recently agreed to is recorded against your account. Continuing to use the Service after a Terms update, once you have been presented with and accepted the new version, means you accept the updated Terms.

2. Description of the Service

Dhobiflow is a software platform that connects laundry vendors with customers, and helps vendors manage orders, payments, and machines (including LG-connected washers and dryers) used to fulfil those orders. Dhobiflow is a technology provider — we do not own, operate, or manufacture the physical laundry machines or premises used by vendors, and we are not a party to the laundry service itself, which is provided by the vendor to the customer.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the laws of Kenya to use the Service. By using the Service, you confirm that you meet these requirements.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and current information (including your phone number) when creating and maintaining your account, and notify us promptly at [email protected] if you believe your account has been accessed without your authorization.

5. Vendor Obligations

If you use Dhobiflow as a vendor, you agree to:

  • Provide accurate information about your business, pricing, and machines.
  • Honor orders you accept through the Service, and communicate promptly with customers about order status.
  • Only use customer data made available to you through the Service (including contact details and order history) for the purpose of fulfilling that customer's orders — not for unrelated marketing or any purpose the customer has not agreed to.
  • Comply with all applicable Kenyan laws relevant to operating a laundry business, including consumer protection and tax obligations.
  • Ensure any machine you connect to Dhobiflow (including LG-connected washers/dryers) is safe, in good working order, and lawfully owned or leased by you.

6. Customer Obligations

If you use Dhobiflow as a customer, you agree to:

  • Provide accurate payment and contact information.
  • Pay for orders you place, using the payment methods supported by the Service.
  • Use vendor equipment and premises lawfully and as instructed by the vendor.
  • Not attempt to access, unlock, or interfere with a machine or order that is not yours.

7. Payments

Dhobiflow currently supports payment via M-Pesa only. We do not collect, process, or store payment card numbers, expiry dates, or card security codes — we have no involvement in card-based payments of any kind. Payment reconciliation (matching an M-Pesa payment to an order) is performed automatically based on the M-Pesa transaction details described in our Privacy Policy. If a payment cannot be automatically matched to your order, you may need to provide the M-Pesa transaction details to your vendor or to us for manual reconciliation.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose, or in a way that infringes the rights of others.
  • Attempt to gain unauthorized access to another user's account, order, or machine.
  • Send fraudulent payment information or attempt to circumvent payment reconciliation.
  • Abuse, spam, or misuse the SMS or notification systems of the Service.
  • Reverse-engineer, scrape, or interfere with the operation, security, or integrity of the Service.
  • Upload or transmit any content (including photos) that is unlawful, harassing, or infringes the rights of any third party.

We may suspend or terminate access to the Service for anyone who violates this section.

9. Machines and Equipment — Disclaimers

Dhobiflow provides software that helps vendors manage and monitor machines, including reading usage and status data from LG-connected washers and dryers via LG's own platform. Dhobiflow:

  • Does not manufacture, sell, install, service, or warrant any physical machine.
  • Is not responsible for the mechanical condition, safety, or performance of any vendor's machine or premises.
  • Relies on data provided by machine manufacturers' own platforms (such as LG ThinQ) for usage and status information, and is not responsible for inaccuracies, outages, or delays originating from those third-party platforms.

Any issue with a physical machine, a laundry order's quality, or a vendor's premises is between the customer and the vendor; Dhobiflow is not a party to that relationship beyond providing the software connecting them.

10. Limitation of Liability

To the maximum extent permitted by Kenyan law:

  • Dhobiflow provides the Service on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, or non-infringement.
  • Dhobiflow will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service.
  • Dhobiflow's total aggregate liability to you for any claim arising out of or relating to the Service will not exceed the total fees you paid to Dhobiflow (if any) in the three (3) months immediately preceding the event giving rise to the claim, or KES 5,000, whichever is greater.
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Kenyan law, including liability for death or personal injury caused by negligence, or for fraud.

11. Indemnification

You agree to indemnify and hold Dhobiflow harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or if we are required to do so by law. Termination does not relieve you of any payment obligations that arose before termination. Sections of these Terms that by their nature should survive termination (including Sections 10, 11, and 13) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or legal requirements. Material changes will be reflected in a new version number and effective date, and you will be asked to review and accept the updated Terms the next time this is required by the Service.
